The Occupational Health and Safety Act 2011, along with its regulations and approved codes of conduct, form a comprehensive legal framework that aims to ensure the health and safety of employees and workplaces. Comcare is the national regulatory body responsible for enforcing the Commonwealth Work Health and Safety Act 2011 and Work Health and Safety Regulations 2011.
This framework is applicable to organizations and entities of all sizes and industries, and its main goal is to protect workers and other individuals from harm to their health and safety caused by work-related risks. It does so by eliminating and minimizing these risks as much as reasonably possible.
The Work Health and Safety Act 2011 (WHS Act) specifically:
- Establishes duties for work health and safety
- Requires elimination or minimization of risks arising from work
- Provides for worker consultation, representation, and participation in health and safety matters
- Enables compliance and enforcement through the regulator
- Allows for the creation of regulations and codes of practice to support the objectives of the WHS Act
