On federal level: Canada Occupational Health and Safety Regulations (SOR/86-304) Part VIII Electrical Safety: Standards 8.3: (1) The design, construction and installation of all electrical equipment, if feasible, shall meet the standards set out in the Canadian Electrical Code, Part I. (2) The operation and maintenance of all electrical equipment shall meet the standards set out in the Canadian Electrical Code. Note: The Canada Occupational Health and Safety Regulations (SOR/86-304) do not apply across Canada. They apply only to federally regulated workplaces as banks, airlines, railways, telecommunications, ports, federal government. In Canada, the most important Legislation for Ex-Safe products is on Provinces and Territories level. Below is a cross-reference of the Canadian equivalent of OSHA for each jurisdiction. Canada has 13 separate occupational health and safety (OHS) regimes (10 provinces + 3 territories). Most of the laws and ordinances base on the CEC (Canadian Electrical Code) plus local additional requirements or exemptions. Unique Ontario legislation: ONTARIO REGULATION 438/07 - PRODUCT SAFETY Deemed approvals 2. (1) An electrical product or device that falls into one of the following categories is deemed to be approved: 1. An electrical product or device for which a certification body has issued a report certifying that the electrical product or device conforms to the applicable standards for the electrical product or device and, i. the report is available to the Authority from the certification body, ii. the electrical product or device complies with all standards of design and construction and all terms and conditions set out in the report, and iii. the electrical product or device bears the certification body’s mark, which identifies the electrical product or device as certified for use in Canada. Notes: - Ontario is the only jurisdiction with a comprehensive regulation dedicated specifically to electrical product approval. - For the other Provinces / Territories find in addition a list for electrical safety of all Provinces and local authorities in: ESSENTIAL CAN Electrical Safety - Devices. Most Provincial and Territorial laws and regulations have included within legislation their specific requirements for electrical equipment approval. This legislation will, in most jurisdictions, specify that electrical equipment cannot be sold or offered for sale unless it bears an approval mark. CEC (Canadian Electrical Code 2024/CSA C22.1:2024): 2-024 Use of approved equipment 1) Electrical equipment used in electrical installations within the jurisdiction of the inspection department shall be approved and shall be of a kind or type and rating approved for the specific purpose for which it is to be employed.
