This ESSENTIAL describes the regulatory requirements for radio equipment (including combined equipment and radio modules) as defined in (RED 2014/53/EU) Article 2 no. 1 section 1 and the legal obligations for manufacturers.
The requirements are valid for modules and devices.
All radio devices are included: Consumer, industrial, toys, Sensors,Radio Modules, ...
General radio approval with focus on short range devices. Mobile phones, fixed radio stations and broadcast items are not in focus of this ESSENTIAL.

The applicable hamonization legislation is the so-called Radio Equipment Directive (RED) 2014/53/EU which is mandatory since 13 June 2016 (Text with EEA relevance).
Cyber security rules for RED
Scope: All products which can be direct or indirect connected to the internet.
Transition time ends at the day before:
(1. August 2024) Update on legislation way. Proposal by EU published in July 2023.
1. August 2025.
Final version of the act is estimated within 2023.
The comittee CEN/CLC/JTC 13 Cyber security and data protection is working on the standards. They will be released hopefully in 2025.

| Scope of legislation |
Article 1 section 1: The Radio Equipment Directive (RED) establishes a regulatory framework for the making available on the market and putting into service in the Union of radio equipment.
What is 'radio equipment" (see 1.6.1 of the EU RED Guide):
"Radio equipment is defined in Article 2.1(1) of the RED as 'an electrical or electronic product, which intentionally emits and/or receives radio waves for the purpose of radio communication and/or radio determination, or an electrical or electronic product which must be completed with an accessory, such as antenna, so as to intentionally emit and/or receive radio waves for the purpose of radio communication and/or radio determination;'
The term 'radio communication' is defined in Article 2.1(2) of the RED as communication by means of radio waves. The term ‘radiodetermination’ is defined in Article 2.1 (3) of the RED as the determination of the position, velocity and/or other characteristics of an object, or the obtaining of information relating to those parameters, by means of the propagation properties of radio waves. The term 'radio waves' is defined in Article 2.1 (4) of the RED as electromagnetic waves of frequencies lower than 3 000 GHz, propagated in space without artificial guide. According to Article 2.2 of the RED, the Commission may adopt implementing acts to determine whether certain categories of electrical or electronic products meet the definition of a radio product. Therefore, the examples mentioned below do not prejudice or affect a future implementing act under Article 2.2. If an implementing act is adopted, the examples will be reviewed accordingly."
