A RoHS legislation (*) does not exist in South Africa.
Therefore this ESSENTIAL prescribes the regulatory requirements in conjunction with E-Waste and general Extended Producer Responsibility (EPR) requirements in South Africa.
(*) EU-RoHS legislation means the restriction of the use of Lead, Mercury, Cadmium, Hexavalent chromium, Polybrominated biphenyls and Polybrominated diphenyl ethers (PBDE) in certain electrical/electronic products (DIRECTIVE 2011/65/EU).
Geltende Rechtsvorschriften:
National Environmental Management: Waste Act, 2008 (No. 59 of 2008)
The Waste Act came into effect on 10 March 2009.
Waste Act (59/2008): Regulations regarding extended producer responsibility (G 43879 – GoN 1184),
in effect since 5 November 2020.
The purpose of these Regulations is-
(1) to provide the framework for the development, implementation, monitoring and evaluation of extended producer responsibility schemes by producers in terms of section 18 of the Act;
(2) to ensure the effective and efficient management of the identified end-of-life products; and
(3) to encourage and enable the implementation of the circular economy initiatives.
